Professional, Legal, and Ethical Issues for Design Professionals - PART II Basic (HALF DAY PROGRAM) Presented by Richard W. Gaeckle, Esq., LEED-AP This half-day program will address legal liability issues confronting the practicing design professional on projects they undertake. The program will address the applicable professional standard of care for the professional architect and engineer and highlight specific liability issues inherent with design practice, including liability for errors and omissions, construction administration and site safety issues. In addition, this program will discuss contractual considerations including defining the scope of the architect and engineers responsibility. The program will also include a brief discussion on risk management strategies to avoid litigation. The Presenter will discuss the individual rules of professional conduct, including the duty to inform and duty to cooperate with the governing boards. This will include the investigative and procedural aspects of an administrative board action and possible sanctions and discipline that architects and engineers may face for misconduct. NOTE: You may attend one or both 4-hour programs for the full 8 hours. Attendance at the morning session is not a prerequisite for attendance at the afternoon session.
Richard W. Gaeckle, Esq., LEED-AP is a Partner in Hoagland Longo's Construction Law Practice Group. After a brief time in private practice, he joined Hoagland Longo in 2003. He also became a LEED Accredited Professional in 2009 and is the team leader for the firm's Green Building Practice Group. The majority of his work focuses on construction litigation and general consultation, with an emphasis on representing design professionals. Clients include architects, professional engineers, landscape architects, golf course architects, interior designers, surveyors, professional planners, and contractors. He has successfully litigated for his clients in the New Jersey civil courts as well as through binding construction arbitration and administrative boards. His experience includes defense of legal claims regarding professional malpractice, condominium litigation, construction site personal injury, property damage, design defects, delay damage, as well as claims arising from inspection and contract administration. In addition, Rich represents professionals and contractors in copyright claims and collection matters. Rich serves as the Co-Vice Chair for the New Jersey Bar Association, Construction Law Section, and is a member of the U.S. Green Building Council- New Jersey Chapter and the Atlantic County Bar Association. Rich has presented a number of workshops for design professionals in New York and New Jersey. This program qualifies for 4 CE hours for: Registration Fees
